Contest Rules & Regulations

1. Contest Period
The contest entry period begins at 12:00 p.m. Mountain Daylight Time ("MDT") on March 11, 2025, and ends at 11:59 p.m. MDT on March 31, 2025 (the "Contest Period"). All entries must be received within this time frame. All scratch-and-win visits must be completed by 7:59 p.m. MDT on April 3, 2025, or while supplies last, Chappelle Gardens Presentation Centre visitors will be able to pick up a scratch and win card.

2. Eligibility
The Contest is open to legal residents of Edmonton, Alberta, Canada, who are over the age of 18 at the time of entry. Those employed by Brookfield Residential (Alberta) LP, Daytona Homes, City Homes, Tacada and Chappelle Gardens Residents Association, as well as members of an employee’s household, are not eligible to enter the Contest. The Contest is subject to all applicable federal and provincial laws and regulations. Void where prohibited. No purchase is necessary.

3. Agreement to Rules
By participating, the Contestant (“You”) agree to be bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Brookfield Residential (Alberta) LP (“Brookfield Residential”) as final and binding as it relates to the Contest.

4. How to Enter
No purchase necessary. The contest can be entered by completing the following steps:

(1) Complete the Contest entry form with your full name, email, and address at chappellegardens.com/scratch-and-win by going directly to the website or scanning the QR code at the Chappelle Gardens Presentation Centre (3704 Cross Landing SW, Edmonton, AB T6W 4M8).

(2) Visit the Chappelle Gardens Presentation Centre to receive your scratch-and-win card. The card must be scratched in front of a Brookfield or Daytona Sales Centre representative.

(3) To win, the Contestant must fulfill all Contest rules and eligibility requirements. Entries that are incomplete, duplicate, or do not adhere to the rules or specifications may be disqualified at the sole discretion of Brookfield Residential. One entry per household. You may not enter more than once by using multiple identities or devices in an attempt to circumvent the rules. The government-issued ID will be verified to match the entry and confirm the home address used on the submission. Any attempt to circumvent the rules, will result in the Contestant’s entry from being removed from eligibility at the sole discretion of Brookfield Residential.

5. Prizes
The Winners of the Contest (the “Winners”) will receive one of three prizes (7 in total), all valued in Canadian Dollars (CAD), as revealed on the scratch card.

Prize #1: Air Conditioning Unit (up to a maximum value of $7,000) by a Brookfield Residential approved vendor.
Prize #2: Bakerstone Original Series Outdoor Multi-Function Cooking Center Propane BBQ in Black (valued at $898 + GST)
Prize #3: $150 Home Depot Gift Card (5 chances to win)
Bonus Draw: If you do not win a prize from the scratch-and-win card, you will have a 1 in 5 chance to win a $50 HomeSense gift card by entering a secondary draw.

Gift Card to actual/appraised value may differ at the time of prize award. The specifics of the prize shall be solely determined by Brookfield Residential.

The prizes are non-transferable, non-fungible, and have no cash value. Acceptance of prizes constitutes permission for Brookfield Residential to use the Winner’s name and a photo of the Winner’s acceptance of the prize, and retain the right to publish the Winner’s name and photo for purposes of advertising and trade without further compensation unless prohibited by law.

6. Odds of Winning
The odds of winning depend on the total number of eligible entries received. A total of 400 cards will be printed.

7. Winner Selection and Notification
All winning cards will have the name of one of the contest prizes printed underneath the scratch surface. Non-winning cards will be marked “Sorry”. It is your responsibility to obtain your card during operating hours at the Chappelle Gardens Presentation Centre. Card must be scratched at the Presentation Centre. Receipt by Winners of the prize offered in this Contest is conditional upon compliance with any and all federal and provincial laws and regulations. Winners will be required to provide a form of government-issued ID that includes the Winner’s full legal name and address that match the original entry. In order to declare a winner, selected entrants must correctly answer a time-limited, mathematical skill-testing question without assistance. Failure to do so will result in disqualification, and an alternate winner may be selected. Any violation of these official rules by Winners at Brookfield Residential’s sole discretion will result in Winners' disqualification as Winner of the Contest and all privileges as Winner will be immediately terminated. All prizes will be issued by April 16, 2025.

8. Rights Granted by You
By entering this contest, You understand and agree that Brookfield Residential, anyone acting on behalf of Brookfield Residential, and Brookfield Residential’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. If the content of your entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Brookfield Residential from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Brookfield Residential may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

9. Terms and Conditions
Brookfield Residential reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should any virus, bug, non-authorized human intervention, fraud, or other cause beyond Brookfield Residential’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Brookfield Residential may select the Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Brookfield Residential. Brookfield Residential reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign, entry forms, or website or violates these Terms & Conditions. Brookfield Residential has the right, in its sole discretion, to maintain the integrity of the Contest, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same device in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by a Contestant to deliberately damage any website or undermine the legitimate operation of the Contest may be in violation of criminal and civil laws. Should such an attempt be made, Brookfield Residential reserves the right to seek damages to the fullest extent permitted by law.

10. Limitation of Liability
By entering, You agree to release and hold harmless Brookfield Residential and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such Contestant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) Physical prize items will be warranted by the supplier/installer of the prize, not Brookfield Residential; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error in the administration of the Contest or the processing of entries.

11. Disputes
This Contest is governed by the laws of Canada and Alberta, without respect to conflict of law doctrines. As a condition of participating in this Contest, the Contestant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively by binding arbitration in Alberta in accordance with the Arbitration Act (Alberta). Further, in any such dispute, under no circumstances shall the Contestant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than the Contestant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). The Contestant further waives all rights to have damages multiplied or increased.
